HB 2661: Legislation for Senior Referral Businesses

The title HB 2661: Legislation for Senior Referral Businesses means protection for seniors. You can rest assured our Golden Placements referral agents have always followed this law. It means that a referral business for seniors operating in any state must register with their state. Our professional placement servers register in Oregon and Northern California.

How the Senior Referral Business law works for you

Understanding and abiding the regulation for everyone is the law. Long term care referral provider register with Department of Human Services. Referral agents or agencies attend classes and presentations to know provisions. Part of the awareness program included a presentation from Mike McCormick. Mike is Deputy Director of Aging and People with Disabilities, Department of Human Services. The presentation was given at the Oregon Senior Referral Agency Association in May 2018.

Why do we want you to know about this law?

First of all, Golden Placements and our affiliates fully champion these regulations. Second, referral agencies and families avoid paying duplicate referral fees! Third, many misunderstandings about consumer protections and/or referral compensation are eliminated. HB 2661: Legislation for Senior Referral Businesses was effective July 1, 2018.

Provisions of the Senior Referral Business Law:

  • REGISTRY

Referral Professionals or organizations making senior living referrals to consumers in Oregon and Northern California must be licensed and registered. Golden Placement specialists are registered with the State of Oregon or Northern California. We are long-term care referral agent.

  • DISCLOSURES

Referral agents must provide an oral and written disclosure statement. The statement is provided to seniors and/or their family members (“consumers”). The disclosure is to communicates our paid referral fees come from senior living communities.

  • REFERRAL COMPENSATION

The law does not exempt any referral agency senior living community partners from paying referral fees on move-ins.

From the bill: “If a client is referred to a facility and the referral agent has received compensation from the facility for the referral, the client may notify the referral agent in writing that the client wishes to use the services of another referral agent in the future for referral to another facility in a subsequent move. After receiving notice under this subsection, the first referral agent may not receive compensation from another facility in a subsequent move for any referral made before receiving the notice.”
  • CHANGE OF REFERRAL REPRESENTATION

Consumers may opt out of additional help. Any family or senior can opt out from a referral agent at anytime. The  ‘opt out’ is simple. You simply must provide written notification directly to the referral agent.

    • MANDATORY REPORTERS FOR ELDER ABUSE

  1. Referral agents must report mentions of alleged elder abuse. If there are signs of elder abuse at senior living communities or if you as a family member suspect abuse call it to our attention. Referral agents facilitate accurate reporting by on going education through Oregon to the Department of Human Services.
  2. Family member are not required to report abuse. As a mater of fact, it is mandatory for referral agents to report. Let us take this burden from you or help you navigate this murky area!
